General Terms and Conditions

By taking out a Membership or purchasing a Blue-bike voucher or a Blue-bike ticket, the holder of the Membership and the user of the Blue-bike voucher / Blue-bike ticket declare to have taken note of these General Terms and Conditions and the Price List (available on the website www.blue-bike.be) and accepts them without reservation.

1) Blue-mobility details

Blue-mobility nv, Carnotstraat 39, 2060 Antwerp, with company number BE 0832-369-965, being the provider of the services.

Blue-mobility can be contacted by e-mail: info@blue-bike.be, or via the contact form on the website.

2) Definitions

Blue-bike:

Bicycle rented by Blue-mobility. The bike may either be equipped with a key lock or a smart lock. Bicycles with a key lock are unlocked with a key that the user obtains after scanning his Blue-bike or MoBIB card on the key dispenser or after entering the code of a Voucher or Blue-bike ticket. Bicycles equipped with a smart lock can be unlocked by holding the Blue-bike or MoBIB card against the card reader of the smart lock or by scanning the QR code on the bicycle with the Blue-bike app or by entering the code of a Voucher or Blue-bike ticket in the Blue-bike app.

Blue-bike account:

When a natural person or an artificial person concludes a contract with Blue-mobility, Blue-mobility creates a Blue-bike account. The Main Account holder can log into his Blue-bike account with his email address and password using the My-Blue-bike application and consult and change his personal and payment details. He can also see how often he has used the bike.

Blue-bike app:

Mobile application of Blue-mobility which can be downloaded for free from the Google Playstore or the iOS Appstore. The Blue-bike app displays in real time the number of bikes available at each Blue-bike rental point. The Membership Holder can consult his rides and start a ride in the app.

Blue-bike card:

Non-personal card which is provided to the Membership holder upon request of the Main Account holder and with which a Blue-bike can be rented at one of the Rental Points for as long as the linked Membership applies.

Blue-bike ticket:

A Blue-bike ticket is a (digital) admission ticket with a unique 10-digit code with a limited period of validity which is issued by Blue-mobility to the MaaS customer or MaaS end user the moment the MaaS customer or MaaS end user purchases a Blue-bike ticket via the MaaS app of the MaaS operator. The Blue-bike ticket entitles the MaaS customer to rent a Blue-bike for a maximum number of hours in accordance with the Price List and in accordance with Blue-mobility's Conditions of Use. For continued use longer than the maximum permitted ride time, the MaaS customer will be charged extra in accordance with our Price List. The Blue-bike ticket may not be resold under any circumstances by the MaaS-customer or MaaS end user to third parties.

Blue-bike voucher:

Voucher in the form of a non-personal unique code with a value that can be used to rent a Blue-bike. A ride with a Blue-bike voucher has a maximum duration (see Price List) and can be used at any Rental Point. The Blue-bike voucher itself can only be used for a limited period. The holder of a Blue-bike voucher can find this on his Blue-bike account, or on the Blue-bike voucher document. If used for longer than maximum permitted ride time, extra charges will be made to the Main Account holder in accordance with the Price List. The Blue-bike voucher may not be resold under any circumstances by the holder of a Blue-bike voucher to a third party.

Blue-mobility:

Blue-mobility nv or one of its authorised representatives.

Blue-bike user:

The natural person who is the holder of a Membership, a Blue-bike voucher or a Blue-bike ticket, or who rides a Blue-bike.

Main account:

The Main Account holder is a natural person or an artificial person who has concluded a contract with Blue-bike with one Membership attached to it.

Holder of a Membership:

Main account holder or Sub-account holder holding a Membership.

Holder of a Blue-bike ticket:

The natural person or artificial person who has purchased a Blue-bike ticket from a MaaS operator via a MaaS app which entitles him to rent a Blue-bike according to the provisions stated in these General Terms and Conditions.

Holder of a Blue-bike voucher:

The natural person or artificial person who has purchased a Blue-bike voucher from Blue-mobility and which gives him the right to rent a Blue-bike according to the provisions stated in these General Terms and Conditions. The holder of a Blue-bike voucher is also the holder of a Membership with Blue-mobility.

Membership

When the Main Account holder registers with Blue-bike, he takes out a Membership with Blue-bike. The Membership entitles the Main Account holder to rent a Blue-bike for the duration of the Membership. If the Main Account holder is a natural person, they can only take out a Membership for an individual person. If the Main Account holder is an artificial person, they must take out a Corporate Membership. If the Main Account holder is an artificial person, they can also choose to take out one (or more) Memberships for one (or more) Sub-account holders. The Sub-account holders may then also rent a Blue-bike at any time for the duration of the Membership. Membership is valid for a period of one year and is automatically renewed. The cost of a Membership can be found in the Price List. A Membership holder can link a Blue-bike card or a MOBIB card to the Membership, which allows them to rent a Blue-bike at one of the Rental Points.

MaaS end-user

The person who uses the MaaS platform to rent a Blue-bike. The MaaS end-user is the MaaS customer if it concerns a non-business MaaS customer.

MaaS customer

Individual consumer or organisation with corporate personality to whom the MaaS operator delivers Bluetickets for payment. The MaaS customer is equal to the MaaS end user if it concerns a non-business MaaS customer.
 

MaaS operator

Artificial person with whom Blue-mobility has entered into a contract for renting Blue-bikes to MaaS customers and MaaS end-users via the MaaS app of the MaaS operator.

My-Blue-bike application:

The secure internet pages under my.blue-bike.be, through which the Main Account holder can access his Blue-bike account.

MOBIB card:

Public transport subscription card available from public transport providers such as SNCB, De Lijn and STIB, to which a Blue-bike Membership can be linked. The MOBIB Card allows you to rent a Blue-bike at one of the Rental Points provided that the linked Membership is valid.

Partner discount:

Blue-mobility concludes agreements with different partners every year. The agreement allows members of the partner to enjoy a special benefit as provided for in the agreement between Blue-mobility and the partner. To claim this benefit, the Membership holder must prove that he is a member of the Partner by providing his membership number. The Membership holder must enter the discount code he has received from the Partner when taking out a Membership via the Blue-bike website.

Sub-account:

The Sub-Account holder is a natural person for whom the Main Account holder has taken out a Membership.

Price list:

List of rates, including the Membership rate, the rent of a Blue-bike, the costs in case of loss and/or theft of any object rented from Blue-mobility, the sending of correspondence by regular mail, compensation and the like.

The Price List can be found on the website www.blue-bike.be and can also be requested from Blue-mobility.

Rental Point:

A Rental Point is any location with a key dispenser where you can borrow a Blue-bike.

 

3) Taking out a Membership

General

Anyone over the age of 18 who satisfies all the conditions in the General Terms and Conditions may take out a Membership with Blue-bike. Natural persons may apply for a private Membership, artificial persons for a Corporate Membership.

A Membership is valid for a period of one year and is extended automatically. The cost of a Membership is set out in the Price List. The Membership holder can link a Blue-bike card or a MOBIB card to their Membership, which allows them to rent a Blue-bike at one of the Rental Points.

If the applicant for Membership has a partner discount code, he can only apply for this discount during the first year of his Membership. In any case, the Membership holder can only apply for one partner discount, even if he is a member of several partner organisations of Blue-mobility.

The cost of a one-year Membership is invoiced in the month following the completion of the Membership. The cost of renting a Blue-bike is charged and paid according to the provisions in article 13.

Blue-mobility is at all times free to turn down new applicants, without giving reasons and at its own discretion.

Online

Taking out a Membership online is done via the website of Blue-bike (www.blue-bike.be). Memberships taken out via the website of Blue-bike will only be accepted after the applicant has confirmed his e-mail address after they have taken out the Membership, and the payment method has been approved by Blue-mobility. The applicant for Membership must confirm his e-mail address via the link in an automatic e-mail he receives from Blue-mobility.

Blue-mobility sends the requested Blue-bike card after the e-mail address has been confirmed. If the Membership holder entered a MOBIB card number, no Blue-bike card will be sent. The Membership is then immediately linked and active after confirmation of the e-mail address and approval of the payment method by Blue-mobility.

A Corporate Membership can only be taken out online, through the Blue-bike website. To take out a corporate Membership, employees of companies, government bodies and organisations, who are authorised to take out a Membership for the company, government body or organisation concerned, can apply. If this person is not a lawful representative of the respective company, government body or organisation, and if the respective company, government body or organisation disputes the validity of the Membership for this reason, all costs incurred by Blue-mobility as a result of this will be recovered from the natural person who signed the contract.

The Main Account holder who has taken out a Corporate Membership with Blue-bike may also take out one (or more) Membership(s) for one (or more) Sub-account(s). Each additional Membership must be linked to a unique e-mail address. The ride data of the Sub-accounts are grouped with the Main Account and invoiced to the Main Account holder. In all other cases, the Main Account of a Corporate Membership is considered equal to the Main Account of a private Membership, and is subject to all conditions and provisions as described in these General Terms and Conditions.

Via a bicycle point

A private Membership can also be taken out via one of the participating bicycle points, which can be found on the Blue-bike website.

A Membership at a bicycle point is taken out when the applicant for the Membership signs the registration form at the bicycle point. The applicant for the Membership will receive a confirmation email and, if applicable, a Blue-mobility card after the Membership has been taken out. Blue-mobility takes care of the electronic registration after it has received the registration form from the bicycle point. There may, therefore, be a couple of days between the Membership application and the confirmation e-mail and, if applicable, the time that the Blue-bike card is sent. The holder of the Membership created at a bicycle point will immediately receive two Blue-bike vouchers, which will be invoiced together with the membership fee during the following month. Therefore, taking out a Membership via the bicycle point is only possible with the formula Membership + 2 Blue-bike vouchers, the prices of which can be found in the Price List.

 4) Duration and Termination of the Membership

The Membership is valid for a period of one year and is extended automatically.

On the expiry date, unless either Blue-mobility or the Membership Holder explicitly terminates the Membership no later than 14 working days before the Membership expires, the Membership will be automatically extended for another period of one year in accordance with the General Terms and Conditions and the Price List that applies at the time of the extension. The Main Account holder may terminate his Membership or the Membership of any Sub-account holders on the personal Blue-bike account via my.blue-bike.be or by e-mail to info@blue-bike.be. If terminated by Blue-mobility, the Membership holder will be notified of this by e-mail sent to the e-mail address provided by him.

In case of persistent non-payment or misuse of the Blue-bike of the Main Account holder or Sub-account holder, Blue-mobility may unilaterally terminate the Membership of the Main Account holder and any Sub-account holders.

5) Right of withdrawal

If the Main Account holder is a company or a natural person acting for purposes relating to his commercial, industrial, artisanal or self-employed activities, he cannot exercise any right of withdrawal.

If the Main Account holder is a natural person acting for purposes outside the scope of his commercial, industrial, artisanal or self-employed activities, he has a right of withdrawal, namely 14 days after the contract has been concluded (conclusion of a Membership or purchase of a Blue-bike voucher). However, in accordance with Article VI.53, 1° of the Belgian Economic Code, the Main Account holder loses his right of withdrawal if the Blue-bike voucher or the Membership was used at the time when the right of withdrawal was exercised.

To exercise his right of withdrawal, the Main Account holder must inform Blue-mobility of his decision before the withdrawal period expires. To do so, he must unambiguously declare that he wishes to terminate the contract.

This declaration should be sent to info@blue-bike.be clearly indicating 'withdrawal' as the subject.

6) Obligations of Blue-mobility

Throughout the duration of the Membership, Blue-mobility undertakes to do its utmost to ensure that a Blue-bike is available at any Blue-bike rental point.

Blue-mobility is not liable for indirect damages that the User of Blue-bike may sustain as a result of temporary unavailability of a Blue-bike at a particular rental point.

Blue-mobility ensures that the User receives a Blue-bike that is in a good and safe condition, meets the legal requirements and is equipped with the necessary means for the User to protect the bicycle against theft.

7) Obligations of the Main Account holder

The Main Account holder has sole legal and financial liability towards Blue-mobility.

If the Main Account holder is not the User of the Blue-bike, he will vouch for the latter and be fully liable to Blue-mobility, both with respect to the rental costs and for any failure by the User to meet his obligations, in particular those set out in articles 9 and 10 of these General Terms and Conditions, as well as for any harmful consequences which would result from this for Blue-mobility.

8) Obligations of the User of the Blue-bike

Prior to use, the Blue-bike User must carry out a simple visual check and report any clearly visible defects to Blue-mobility via the automatic rental system for bikes equipped with a key lock, or via the Blue-bike app for bikes equipped with a smart lock, or in exceptional cases by e-mail.

After using a Blue-bike equipped with a key lock, its User must return the Blue-bike and the key to the key dispenser of the rental point where he rented the Blue-bike, in the same condition as when he received it, on the understanding that he is assumed to have received it in perfect condition. However, the Blue-bike User has the right to return the bicycle within fifteen minutes of its receipt, free of charge, to the rental point where it was borrowed, if the Blue-bike has a defect and this defect is not attributable to the User of the Blue-bike.

After using a Blue-bike equipped with a smart lock, the User must return the Blue-bike to the Rental Point where he rented it and lock the smart lock. The User must leave the Blue-bike in the same working order in which he received it, it being understood that he will be presumed to have received it in perfect condition.

The User of the Blue-bike must handle the bicycle with due care. This means, among other things, that he respects the traffic rules and the highway code, that he only uses the Blue-bike on public roads, more specifically where its use is permitted, and that he does not endanger himself or others.

When parking the bicycle, the User must always lock the Blue-bike. For bicycles equipped with a key lock, the bicycle must be locked with the accompanying padlock. For bicycles equipped with a smart lock, the bicycle must be locked by pushing down the handle of the smart lock. If the Blue-bike is found unattended and unlocked, it may be confiscated by Blue-mobility or one of its agents. The Main Account holder will be notified of this as soon as possible and any costs incurred may be charged to him.

The User of Blue-bike may not make any changes to the bicycle (except saddle height adjustment).

The User of the Blue-bike may not transport other persons on the Blue-bike.

The User of the Blue-bike may be a minor, provided that he is at least 14 years old. The Blue-bikes are not accessible to minors under the age of 14, even if accompanied by an adult. If Blue-mobility establishes a breach of this provision, the Main Account holder will be held liable for any damage suffered by any person that may result from this unlawful use.

The User of Blue-bike declares that he is in good physical condition and meets all legal requirements to ride the Blue-bike concerned.

9) Conditions of use of Blue-bikes

The rent of a Blue-bike is limited to a maximum number of hours in accordance with the Price List. Any rental longer than 24 hours will involve additional costs in accordance with the Price List. It is not permitted to keep the Blue-bike longer than 72 hours.

If you have a Membership, you can rent maximum two Blue-bikes at a time by using the card or the app twice in a row.

If the User of a Blue-bike returns the bike to a different rental point, and returns the key in a different key dispenser than the one where he/she rented the bike and key, the Main Account holder will be charged a supplement, the amount of which can be found in the Price List.

If the User of the Blue-bike does not return the bicycle within 24 hours, Blue-mobility will charge the Main Account holder a supplement on top of the amount for the rental, as included in the Price List.

If the Blue-bike User returns the bicycle more than 30 days after he has rented it, the lump sum as listed in the Price List will not be refunded by Blue-mobility to the Main Account holder, in order to compensate for the administrative costs and commercial loss suffered by Blue-mobility due to the absence of the Blue-bike. Any additional costs caused by damage to the Blue-bike may be charged in addition to these costs.

10) Damage to the Blue-bike and repairs

Any damage caused to the Blue-bike during the period of use will be at the expense of the Main Account holder. Blue-mobility will inform the Main Account holder by e-mail of the nature of the damage and the amount of the repair costs. The Main Account holder will then have four weeks to lodge a notice of objection to the amounts requested. If the Main Account holder does not respond, Blue-mobility will charge him for the costs of repair.

The User of the Blue-bike is strictly prohibited from carrying out repairs on the Blue-bike by himself or by a third party, except in case of a puncture. Any repairs prohibited by this provision or non-compliant repairs will be charged to the Main Account holder.

The Main Account holder must report any damage to the Blue-bike to Blue-mobility as soon as possible (via: info@blue-bike.be).

11) Loss and theft

In the event of loss, theft or damage of the Blue-bike card or MOBIB card, the Main Account holder must block the card on my.blue-bike.be as soon as possible, or notify Blue-mobility by e-mail (info@blue-bike.be) in order for Blue-mobility to block the Blue-bike card. Failing this, the Main Account holder will be fully liable for the consequences of using this card. In addition, the Main Account holder must pay the replacement costs of the card in accordance with the Price List.

In the event of loss or theft of the Blue-bike, the Main Account holder will be liable, for the entire rental period of the bicycle, for the damage suffered by Blue-mobility as a result, up to the maximum amount specified in the Price List per incident and per Blue-bike.

However, the Main Account holder will only be liable for the amount corresponding to the "excess" as stipulated in the Price List, if the User of the Blue-bike can prove that he locked the Blue-bike using the padlock provided and that he has returned the key, together with a copy of the theft report, to Blue-mobility.

In the event of loss of the key of the Blue-bike, the Main Account holder must pay the replacement cost of the key according to the Price List.

12) Invoicing and payment

Invoicing and payment methods for a private Membership:

A new private Membership is paid by direct debit only:

When taking out a Membership, the Main Account holder authorises Blue-mobility to collect the amounts due automatically.

The Membership fee due will be collected two months after the start of the respective Membership period at the latest.

The rental costs are determined once a month and are based on the frequency of use during the previous month. Before the amounts due are collected, which happens once a month, Blue-mobility sends a statement.

If a Partner Discount applies, Blue-mobility will automatically deduct the discount from the Membership fee or fare.

Main Account holders who previously chose to pay by credit card now exceptionally pay by bank transfer. They receive a statement with the amount to be paid and the payment deadline.

Invoicing and payment methods for corporate Membership:

Corporate Membership holders can choose to pay by bank transfer or by direct debit. The rental fee is determined once a month and is based on the frequency of use during the previous month.

Before the amounts due are collected by direct debit, which takes place once a month, Blue-mobility sends an invoice. If the Member chooses to pay by direct debit, he must pay the invoices before the payment deadline into the account of Blue-mobility.

If a Partner Discount applies, Blue-mobility will automatically deduct the discount from the Membership fee or fare.

Main Account holders who previously chose to pay by credit card now exceptionally pay by bank transfer. They receive an invoice with the amount to be paid and the payment deadline.

13) Late payment

The Main Account holder is late with the payment if he fails to pay on the date mentioned on the invoice or statement, in accordance with the applicable payment method. If the Main Account holder fails to pay, or the direct debit cannot be collected, he will receive a reminder from Blue-mobility. Regardless of the chosen payment method, this amount must be paid by bank transfer.

The Master Account holder will then be obliged to take care of this within the next 14 working days. If the situation has not been taken care of within this period, Blue-mobility reserves the right to block the Membership.

Payments made after this deadline will, by operation of law and without notice of default, be subject to an interest of 2.5%, as well as (also by operation of law and without notice of default) a flat-rate compensation of 10% of the invoice amount for damages, with a minimum of EUR 75.

14) Amendment

Blue-mobility reserves the right to amend the Price List and/or these General Terms and Conditions by means of a notice communicated one month before it comes into effect:

via the Internet site: www.blue-bike.be and

-by an e-mail to the Membership holder

The Membership holder is entitled to terminate his/her membership in connection with the new Price List and/or General Terms and Conditions, insofar as these new Price List and/or General Terms and Conditions involve a change to the already existing contractual rights and obligations of the Membership holder. The Membership holder may exercise this statutory right of cancellation up to and including the day before the new Price List and/or General Terms and Conditions come into effect, by sending an email to info@blue-bike.be and specifically mentioning that he/she wishes to terminate his/her Membership in view of the new Price List and/or General Terms and Conditions. The termination takes effect as soon as the new Price List and/or General Terms and Conditions come into force. The Membership costs will be refunded on a pro-rata basis.

15) Complaints

 Any complaint should be submitted in due time to:

  • Blue-mobility, 2060 Antwerp, Carnotstraat 39.
  • Or by e-mail to info@blue-bike.be with "Complaint" in the subject line.

Complaints submitted within one month from the date of the incident giving rise to the complaint will be considered as timely. Blue-mobility will respond in writing within four calendar weeks to complaints submitted in writing or inform the Membership holder or the Holder of the Blue-bike voucher within the same period of the time they need to respond. This notice may also include a request for further information and the submission of more detailed supporting documents, which, in Blue-mobility's opinion, are necessary for a response. If the parties fail to reach agreement on how to resolve the complaint, either party may apply to a competent court as stipulated in article 18.

16) Privacy policy

Who are we and how can the User contact us?

The public limited company Blue-mobility (hereinafter "Blue-mobility"), registered with the Crossroads Bank for Enterprises (KBO) under number 0832.369.965, having its registered office in 2060 Antwerp, Carnotstraat 39. Blue-mobility is responsible for the promotion, communication, invoicing, administration and operation of the bike-sharing system 'Blue-bike'.

Questions concerning the protection of personal data can be asked via the online contact form or directly in an e-mail to info@blue-bike.be.

Blue-mobility ensures the privacy of its customers and always acts in accordance with the provisions of the General Data Protection Regulation (GDPR 2016/679 of 27 April 2016).

What data is collected and why?

Blue-mobility processes personal data of its Main Account holders and Sub-account holders to which a Membership was linked for the following reasons:

  1. Taking out memberships
  2. Issuing Blue-bike cards
  3. Issuing Blue-bike invoices
  4. Issuing Blue-bike vouchers
  5. Providing necessary information such as changes in the price
  6. Answering queries from Master Account holders and Sub-account holders
  7. Market research and market analysis

When registering Main Account holders and Sub-account holders, Blue-mobility collects various data, including the customary personal data (for the Main Account holder: name, address details, date of birth, telephone number or mobile phone number, bank account number, BIC, email address; for the Sub-account holder: name, email address). The provision of all this personal data is necessary to be able to use a Blue-bike. For business customers (cf. corporate membership), the company number is also requested.

The data is used to process requests and orders or to offer the necessary services or assistance. It can also be used for surveys and evaluations (if you subscribe to the newsletter) as well as for e-mails about work, defects or price changes. Blue-mobility can also file anonymously, without any restriction, the data about travel behaviour, times and places of travel. In that case, Blue-mobility ensures the anonymity of this data. The collected data is used for market research and market analysis.

Blue-mobility uses market analysis, for example, to pursue a target-group policy, to differentiate prices and to match supply to demand as much as possible. In addition, the analyses are also used to optimise accessibility. Personal data is not used on an individual level but is always anonymised before it is used for market research.

Location Data

Blue-mobility collects and processes location data from the User of a Blue-bike when the User rents a Blue-bike equipped with a smart lock. By renting a Blue-bike equipped with a smart lock, the User agrees to the collection and processing of the location data of the relevant ride.

The location data are collected through a track & trace function with which the smart lock is equipped and is linked to the profile of the Membership Holder in the Blue-bike app. The location data are only collected during the period that the User rents the Blue-bike.

The Membership Holder can consult the location data of the rides made in his Blue-bike app. Blue-mobility will not consult the location data of the rides save in exceptional cases such as when a bike is lost or stolen. The anonymised ride data may be shared with third parties such as a city or municipality for mobility policy developments.

 

Emails via contact form

The Blue-bike website includes a contact form, allowing you to send questions or remarks to a mailbox. When sending the message, the User of the contact form agrees that Blue-mobility will use the data provided (including name and e-mail address) to contact the User of the contact form exclusively for the information requested by the User on the contact form. These e-mails will be kept as long as, but not longer than, Blue-mobility considers necessary to guarantee a correct service.

Newsletters

Blue-mobility uses Mailchimp for newsletters. Newsletters are only sent with the explicit approval of the Master Account holder. The Master Account holder can adjust his newsletter preferences on a personal online account on www.my.blue-bike.be. Non-members can also subscribe to the newsletter through www.blue-bike.be and can unsubscribe at any time.

Who receives this data?

Blue-mobility may transfer certain personal data to third parties acting as subcontractors on behalf of Blue-mobility. In this case, they will only have access to the data necessary for the performance of their task.

Whenever the Membership holder uses a Blue-mobility Partner discount in cooperation with one or more partners, one of the conditions for enjoying the offer may be that the Membership holder agrees that Blue-mobility or the partner in question contacts them by e-mail; or that certain personal data such as bicycle usage is shared. When appropriate, the Membership holder agrees that Blue-mobility may, if necessary, disclose certain personal data to the partner concerned. If this is the case, this will always be explicitly mentioned when used during a promotion campaign.

The rights of the data subjects

Blue-mobility ensures the privacy of its customers and therefore always acts in accordance with the provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) hereinafter referred to as the "GDPR".

As a data subject, the User has the right to inspect, rectify or, if they have no current Membership or outstanding payments, to delete the personal data in accordance with the GDPR. How is the data secured?

The programmes in which the data and passwords are processed comply with the legal obligations. To prevent anyone from obtaining these collected personal data, firewalls are used on the website. The personal data provided through the website is stored and processed through an electronic system managed by Blue-mobility in a closed, secure environment which is not publicly accessible.

17) Applicable law and competent court

These General Terms and Conditions are subject to Belgian law. Any dispute concerning their execution and consequences which cannot be resolved amicably between the parties will be submitted to the territorially competent courts in accordance with Article 624 of the Judicial Code.
